    who is responsible for the upkeep of eagle bay village grass mowing and trimming down Palm Drive also infrastructure such as roadside storm water drains which seem full of weeds, grass which end up down the stormwater drains ect . The estate at the moment looks a disgrace and unattractive to perspective land purchasers. While current residences do our best to present our properties it is a pity to see this work not being kept up.

    Although this is probably not the ideal forum to discuss issues where I have close personal involvement, because the issue was raised here, it is answered here.
    The maintenance of the estate falls on a number of persons.
    Technically the entrance road and the Reserve could and should be transferred to the Council, but Eagle Bay Village currently does the lawn mowing and replacement of trees if necessary.
    The roads, drains and footpaths are the responsibility of the Council.
    The lights are the responsibility of the electricity supplier.
    The nature strips are the responsibility of the owners. Each owner is responsible for the nature strip in front of his/her allotment.
    The mowing and maintenance of the various allotments, whether vacant or built on is the responsibility of the individual owners.
    There is a tree in front of each house allotment and this is the responsibility of the owner of the adjoining allotment.
    Whilst not specifically raised, the issue of builders rubbish was apparently raised in the local newspapers. In the past, because specific littering builders have been hard to identify on casual visits, Eagle Bay Village Pty Ltd frequently cleaned builder’s rubbish from the development.
    The rubbish blowing around is the responsibility of either the owners of existing houses, the present builders of houses or the owners of the lots being built on. It is not the responsibility of Eagle Bay Village Pty Ltd and Eagle Bay Village Pty Ltd has no control over unidentified individual litterers.
    Instead of complaining, a reasonable person would be pro-active and either pick up the rubbish or identify the litterer, gather the necessary evidence and report that offender in a signed written statement to the relevant authority which could then take action. Simply observing the rubbish and complaining to anyone who will listen will not achieve any result.
    There is no doubt that those recently complaining of builder’s rubbish, were conspicuous by their absence, when the very same builders were leaving rubbish while building the complainant’s houses.
    Today, Eagle Bay Village Pty Ltd only owns 10 adjoining Lots in Eagle Bay Terrace, at the north-west corner of the development and a section of land 8314 sq.m. at the entrance which will soon be developed and the land sold. There are another 4 Lots in the Basstian Court subdivision and 1 lot in the Bindi Court subdivision which are owned by Eagle Bay Village Pty Ltd. Outside of these, Eagle Bay Village has no responsibility.
    Having said that, in the past Eagle Bay Village Pty Ltd has watered the trees and replaced them where necessary, mown the entrance, mown the reserve, mown all of the nature strips, picked up the rubbish left by builders working for individual land owners, and mown the grass on the lots owned by various owners. This work has been done without fuss or bother or charge to those owners.
    Additionally, Eagle Bay Village Pty Ltd has been the only entity to enforce the covenant which is the primary instrument for maintaining the quality of the estate. That responsibility is or should be shared by all of the owners as they are all equal parties to the covenant. Not one present landowner has enforced the covenant, which may be an indication that they just don’t care.
    It is time that all owners took responsibility for the estate and mowed their own land, mowed and maintained their own nature strips, cared for their own trees and took responsibility for ensuring that other owners or builders were not permitted to litter the estate. It is not for Eagle Bay Village Pty Ltd to show land owners how to do that.
    As for the grass, Eagle Bay Village Pty Ltd will determine when it will be cut and makes that decision based on the same successful parameters and criteria used since 2005.
